    Savannah Tributes LLC (“Company,” “we,” “us,” “our”) respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you visit our website and use our services (collectively, the “Services”). By using the Services, you consent to the practices described in this Policy. If you do not agree, please do not use the Services.

    This Privacy Policy is incorporated into and subject to our Terms of Service.

    1. Information We Collect

    1.1 Information You Provide Directly

    • Account Information: Name, email address, password, phone number when you register.
    • Tribute Content: Obituary text, photographs, videos, audio recordings, and other memorial content you submit.
    • Guestbook Entries: Messages, memories, and media shared by visitors.
    • Payment Information: Billing details processed by our third-party payment processor, Stripe. We do not store full credit card numbers on our servers.
    • AI Writing Inputs: Biographical details, memories, and other information you enter into our AI-assisted obituary writer. See Section 3 for how this information is processed.
    • Communications: Correspondence you send to us, including support requests and feedback.
    • Funeral Home Partner Information: Business name, address, staff details, and service information for partner funeral homes.

    1.2 Information Collected Automatically

    • Device and Usage Data: IP address, browser type and version, operating system, referring URLs, pages viewed, time and date of visits, and click patterns.
    • Cookies and Similar Technologies: We use cookies, web beacons, and similar technologies to collect information about your browsing activities. See Section 7 (Cookie Policy) for details.
    • Location Data: Approximate geographic location inferred from your IP address.
    • Analytics Data: Aggregated data about service usage, performance metrics, and error logs.

    2. How We Use Your Information

    We use collected information for the following purposes:

    • Provide and Operate the Services: Create and manage accounts, process tributes, display memorial content, and facilitate guestbook interactions.
    • Process Payments: Facilitate payment processing through Stripe for paid tribute packages and memorial products.
    • Communicate With You: Send service-related notices, respond to support requests, and provide updates about your tributes.
    • Improve the Services: Analyze usage patterns, diagnose technical issues, and develop new features.
    • Personalization: Customize your experience based on your preferences and usage history.
    • Marketing: Send newsletters and promotional materials (with your consent; you may opt out at any time).
    • Safety and Security: Detect, prevent, and address fraud, abuse, security risks, and technical issues.
    • Legal Compliance: Comply with applicable laws, regulations, legal processes, and governmental requests.

    3. How We Share Your Information

    We do not sell your personal information. We may share information in the following circumstances:

    • Service Providers (Subprocessors): Third-party vendors who process data on our behalf, subject to contractual obligations to protect your data: Supabase (database, authentication, and file storage), Vercel (website hosting), Stripe (payment processing), Resend (email delivery), Anthropic (AI processing — see below), and Meta Platforms (social media announcements — see below).
    • AI-Assisted Obituary Writing: When you use our AI-assisted obituary writer, the information you enter (such as biographical details and memories of your loved one) is transmitted to Anthropic, our AI service provider, to generate draft obituary text. We do not permit our AI provider to use this information to train its models.
    • Social Media Announcements: When a tribute is published publicly, we may automatically share an announcement of it — typically the name, age, city, date of passing, and a link to the tribute page — on our official social media pages, including our Facebook Page operated on Meta Platforms. This applies only to tributes designated as public. Content shared on social media is subject to the privacy policies of those platforms.
    • Legal Requirements: When required by law, subpoena, court order, or governmental regulation, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
    • Business Transfers: In connection with a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred as a business asset.
    • Public Content: Tribute pages, obituaries, guestbook entries, and other memorial content designated as public may be viewed, indexed by search engines, and shared by other users.
    • With Your Consent: In any other circumstances where you have given explicit consent.

    4. Data Security

    We implement commercially reasonable technical and organizational measures to protect your personal information, including encryption in transit (TLS/SSL), secure authentication, and access controls. However, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security and are not responsible for unauthorized access resulting from circumstances beyond our reasonable control.

    5. Data Retention

    We retain personal information for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. Tribute content may be retained indefinitely as part of the memorial record unless deletion is requested by the account holder. Upon request, we will delete or anonymize your personal information within a reasonable timeframe, subject to legal obligations and legitimate business needs.

    6. Children’s Privacy

    The Services are not directed to individuals under the age of thirteen (13). We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us at legal@savannahtributes.com and we will promptly delete such information.

    7. Cookie Policy

    7.1 What Are Cookies?

    Cookies are small text files stored on your device when you visit a website. They help the site remember information about your visit and make your next visit easier.

    7.2 Types of Cookies and Similar Technologies We Use

    • Essential: Required for the basic functioning of the Services, including authentication, session management, security, and error diagnostics. These cannot be disabled.
    • Functional: Remember your preferences and settings (e.g., sidebar state, display preferences) using browser storage on your device.
    • Analytics: With your consent, we collect usage statistics (such as pages viewed and interactions) to understand how visitors use the Services. Analytics collection runs only if you choose “Accept All” in our cookie consent banner. If you choose “Essential Only” or make no choice, analytics events are not collected.

    7.3 Managing Your Consent

    When you first visit our site, a cookie consent banner allows you to accept all cookies or limit to essential cookies only. Your choice is stored on your device. To change a previously recorded choice, clear this site’s stored data in your browser settings and make a new selection when the banner reappears, or contact us at legal@savannahtributes.com. You may also manage cookies through your browser settings. Note that disabling essential cookies may affect the functionality of the Services.

    7.4 Do Not Track

    Some browsers transmit a “Do Not Track” (DNT) signal. We currently do not respond to DNT signals, as there is no industry standard for compliance. We will update this Policy if a standard is established.

    8. Your Rights and Choices

    8.1 All Users

    • Access: Request a copy of the personal information we hold about you.
    • Correction: Request correction of inaccurate or incomplete data.
    • Deletion: Request deletion of your personal information, subject to legal retention requirements.
    • Opt-Out of Marketing: Unsubscribe from marketing emails using the link in any email or by contacting us.
    • Cookie Preferences: Manage cookie consent through our cookie banner or your browser settings.

    8.2 California Residents (CCPA/CPRA)

    If you are a California resident, you have additional rights under the California Consumer Privacy Act and the California Privacy Rights Act, including the right to know what personal information we collect and share, the right to delete your personal information, the right to opt out of the sale of personal information (we do not sell personal information), and the right to non-discrimination for exercising your privacy rights.     8.3 Virginia, Colorado, Connecticut, and Other State Residents

    Residents of states with comprehensive privacy laws (including the Virginia CDPA, Colorado Privacy Act, Connecticut Data Privacy Act, and similar legislation) may have additional rights regarding access, correction, deletion, and opting out of certain data processing activities.     8.4 European Economic Area, UK, and International Users (GDPR)

    If you are located in the EEA, UK, or other jurisdiction with data protection laws, you may have additional rights, including the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal information. Our legal bases for processing include consent, contractual necessity, legitimate interests, and legal compliance.     9. International Data Transfers

    Your information may be transferred to, stored, and processed in the United States, where our servers and central database are located. By using the Services, you consent to the transfer of your information to the United States, where data protection laws may differ from those in your country of residence. We take reasonable steps to ensure your data is treated securely and in accordance with this Policy.

    10. Third-Party Links and Services

    The Services may contain links to third-party websites, services, or content not operated or controlled by us (including donation links, external funeral home websites, and social media platforms). We are not responsible for the privacy practices of such third parties. We encourage you to review their privacy policies before providing any personal information.

    11. Changes to This Privacy Policy

    We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the revised Policy on the Services and updating the “Effective Date” above. Your continued use of the Services after such changes constitutes your acceptance of the revised Policy.
